رئيس واعضاء محكمة العدل الدولية المحترمون/ لاهاي

من ديباجة ميثاق الامم المتحدة الذي وقع في 1945 لتاسيس المم المتحدة من اجل تحقيق السلام والعدل الدولين وعندما اتفقوا ان يكتبوا كما ادناه :
نحن شعوب الأمم المتحدة وقد آلينا على أنفسنا
- أن ننقذ الأجيال المقبلة من ويلات الحرب التي في خلال جيل واحد جلبت على الإنسانية مرتين أحزاناً يعجز
عنها الوصف،
- وأن نؤكد من جديد إيماننا بالحقوق الأساسية للإنسان وبكرامة الفرد وقدره وبما للرجال والنساء والأمم كبيرها وصغيرها من حقوق متساوية.
- وأن نبيّن الأحوال التي يمكن في ظلها تحقيق العدالة واحترام الالتزامات الناشئة عن المعاهدات وغيرها من مصادر القانون الدولي.
- وأن ندفع بالرقي الاجتماعي قدماً، وأن نرفع مستوى الحياة في جو من الحرية أفسح.
وفي سبيل هذه الغايات اعتزمنا
1- أن نأخذ أنفسنا بالتسامح، وأن نعيش معاً في سلام وحسن جوار ،
2- وأن نضم قوانا كي نحتفظ بالسلم والأمن الدولي،
3- وأن نكفل بقبولنا مبادئ معيّنة ورسم الخطط اللازمة لها ألاّ تستخدم القوة المسلحة في غير المصلحة المشتركة ،
4- وأن نستخدم الأداة الدولية في ترقية الشؤون الاقتصادية والاجتماعية للشعوب جميعها،

من الديباجة اعلاه ننطلق في ما نكتب ونطلب منكم ايها السادة في محكمة العدل الدولية – لاهاي لاننا التاريخ والحضارة وننتمي الى ارض ووطن علم الانسان القانون والشريعة والوطن الذي ينتمي اليه حمورابي اول من سن شريعة القانون في تاريخ البشرية ونتمتع في شخصيتنا العراقية بالحرية والسلام وحب التعايش السلمي بين شعوب الارض لذلك انطلقنا من مشروعنا الانساني في بناء وطننا على اسس المحبة والسلام .
اذ اننا كنا نعيش في سلام دائم في وطننا العراق شعب واحد لاتفرقه الكلمة الواحدة وتحت سلطة نظام كان قد اعطى كافة الحقوق المشروعة للمواطن العراقي الذي يعيش في العراق وتحت سلطة تشريعية وتنفيذية وكانت النظام ملزما بتوفير كافة الحقوق المشروعة وفي كافة المجالات الاجتماعية المرتبطة بالانسان العراقي وكنا نتمتع بكافة الحقوق المشروعة التي سنها الدستور العراقي ولافرق بين فئات المجتمع العراقي المتعددة في الحقوق والواجبات .
وبناءا على المادة الثانية من الفقرة 3 و4 من ميثاق الامم المتحدة
المادة 2
3-يفض جميع أعضاء الهيئة منازعاتهم الدولية بالوسائل السلمية على وجه لا يجعل السلم والأمن والعدل الدولي عرضة للخطر.
4-يمتنع أعضاء الهيئة جميعاً في علاقاتهم الدولية عن التهديد باستعمال القوة أو استخدامها ضد سلامة الأراضي أو الاستقلال السياسي لأية دولة أو على أي وجه آخر لا يتفق ومقاصد "الأمم المتحدة"..

فقد تم الاعتداء على وطننا العراق واحتلالة والغاء استقلاله السياسي والاقتصادي من قبل تحالف استعماري قادته الولايات المتحدة الامريكية وبريطانيا والدول التي تحالفت معها وذلك منذ 20-3-2003 خلافا لمبادئ ميثاق الامم المتحدة وتسبب هذا الاعتداء الاستعماري من احتلال بلدنا
النتائج التي تمخضت عن الاحتلال هي:
‎
1-استشهاد مليون ونصف المليون مواطن عراقي برئ دون ذنب
‎ 2- تشريد اكثر من اربعة ملايين مواطن عراقي خارج العراق .
3- خمسة ملايين ارملة ويتيم
4- تدمير البنية التحتية للعراق بالكامل وفي كل المجالات الاقتصادية والصحية والتعليمية والعسكرية والمجتمعية

‎5- الغاء المؤسسات العسكرية والامنية والاعلامية التي كانت تشكل المفصل الرئيسي في حماية وحدة الشعب العراقي وحماية سيادة العراق وسلامة حدوده من الاعتداءات الخارجية واحلال محلها جيش من الميلشيات ** والعنصرية والتي ليس لها ولاء للانتماء الوطني بل تعمل تحت تكتلات سياسية .
‎6- اصدار قرارات لاتمت باي صلة للمنهج الديمقراطي بل تنتمي للمنهج الدموي والاستعماري كما تدعي عندما اصدرت قرار اجتثاث البعث واجتثاث دوائر مهمه في الدوله وهي الجيش العراقي الذي عمره 91 عاما وكذلك الاجهزة الامنية بكل انواعها التي كانت هذين المؤسستين يشكلان منهج البناء الوطني للمجتمع العراقي اما بعد الاحتلال شكلت على اساس التبعية ** والعنصرية .وكذلك الغاء دوائر مهمة مثل وزارة الاعلام العراقية وفي هذه القرارت يدلل الاحتلال انه يريد تدمير العراق ويشارك في قتل العراقيين وبكل الوسائل ومنها الاجتثاث وهذه نوع من انواع *** الدولي للمجتمعات ونوح جديد من القتل الجماعي اللاانساني الذي مارستة دول الاحتلال ..لكنها لم تحاسب جنودها على قتل ملايين الابرياء من العراقيين.
7- اعطت لنفسها الحق في اعتقال قيادة النظام الوطني الشرعي وفقا لميثاق الامم المتحدة كون العراق عضوا في الامم المتحدة وعملت على تاسيس محكمة سياسية لاشرعية لان العراق تحت بند الاحتلال من قبل قوات الاحتلال واستمرت في اعمالها ***ية عندما قامت بتسليم قادة العراق الشرعيين الى الميلشيات ليقوموا باغتيالهم واليوم يكررون ذات الجريمة بتسليمهم القادة الاسرى لديهم الى حكومة لاشرعية نصبت من قبل الاحتلال اللاشرعي اتقوم باغتيالهم بابشع جريمة ارهاب عرفها التاريخ البشري الحديث .


وبناءا على المادة السادسة من ميثاق الامم المتحدة الذي ينص :
المادة 6
إذا أمعن عضو من أعضاء "الأمم المتحدة" في انتهاك مبادئ الميثاق جاز للجمعية العامة أن تفصله من الهيئة بناءً على توصية



ومن الفصل السابع المادة 39 من الميثاق ادناه:

المادة 39
يقرر مجلس الأمن ما إذا كان قد وقع تهديد للسلم أو إخلال به أو كان ما وقع عملاًً من أعمال العدوان، ويقدم في ذلك توصياته أو يقرر ما يجب اتخاذه من التدابير طبقاً لأحكام المادتين 41 و42 لحفظ السلم والأمن الدولي أو إعادته إلى نصابه.
وفي المادة 51 من الفصل السابع ادناه :

ليس في هذا الميثاق ما يضعف أو ينتقص الحق الطبيعي للدول، فرادى أو جماعات، في الدفاع عن أنفسهم إذا اعتدت قوة مسلحة على أحد أعضاء "الأمم المتحدة" وذلك إلى أن يتخذ مجلس الأمن التدابير اللازمة لحفظ السلم والأمن الدولي، والتدابير التي اتخذها الأعضاء استعمالاً لحق الدفاع عن النفس تبلغ إلى المجلس فورا، ولا تؤثر تلك التدابير بأي حال فيما للمجلس - بمقتضى سلطته ومسؤولياته المستمرة من أحكام هذا الميثاق - من الحق في أن يتخذ في أي وقت ما يرى ضرورة لاتخاذه من الأعمال لحفظ السلم والأمن الدولي أو إعادته إلى نصابه.



نحن عراقيون من اجل التحرير والداعمون لكل التوجهات التي تصب في تحقيق العدالة والسلام في العالم ندعم توجهكم الحقيقي من اجل اظهار الحقائق وتقديم كل المجرمين الذين ساهموا في تدمير السلام العالمي في العالم والذين يجازفون بسياسة بلدانهم وشعوبهم ومستقبلها السياسي ومستقبلها في العلاقات مع الشعوب

اننا بأسم مبادئ السلام والعدالة الدوليين نتقدم بهذا الطلب من محكمتكم تنفيذ البنود اعلاه من ميثاق الامم والمتحدة والذي انتم تشكلون المحكمة الدولية الرئيسية المرتبطة بالامم المتحدة لاتخاذ التدابير القانونية بفصل وطرد كل الاعضاء الدائميين وغير الدائميين الذين شاركوا في الاعتداء على العراق واحتلاله وكذلك اصدار مذكرة توقيف بكل قادة الدول التي ساهمت في احتلال العراق وفي مقدمتهم المجرم ***ي رئيس الولايات المتحدة الاسبق جورج بوش وكذلك رئيس الوزراء البريطاني الاسبق توني بلير وكل قادة الدول التي ساهمت بالعدوان على العراق واحتلاله والذين خرقوا ميثاق الامم المتحدة مما تسببوا في تدمير دولة ذات سيادة سياسية واقتصادية وتسببوا بالاضرار التدميرية المذكروه اعلاه ..ونطلب تطبيق المواد القانونية الرسمية بحق المجرمين الذين تسببوا بهذه الكارثة البشرية التي تعرض لها شعبنا ووطننا واننا جزء من تلك الجريمة ونحن مشردون في كل بلدان العالم بعد ان كنا نعيش آمنيين في بلادنا .

ومن منطلق إنماء العلاقات الودية بين الأمم على أساس احترام المبدأ الذي يقضي بالتسوية في الحقوق بين الشعوب وبأن يكون لكل منها تقرير مصيرها، وكذلك اتخاذ التدابير الأخرى الملائمة لتعزيز السلم العام
وتحقيق السلام والعدالة بين الشعوب

Of the preamble to the Charter of the United Nations, signed in 1945 of the founding of the United of Nations in order to achieve peace and justice internationally and when they agreed to write as below:

We the peoples of the United Nations has it upon ourselves
- To save succeeding generations from the scourge of war which twice in our lifetime has brought sorrow to mankind twice unable

- And to reaffirm faith in fundamental human rights, in the dignity and worth of men and women and of nations large and small have equal rights.
- To establish conditions under which justice and respect for obligations arising from treaties and other sources of international law.
- And to promote social progress and better standards of life in larger freedom.

To these goals we intend to

1- To practice tolerance and live together in peace and good neighborliness,
2 - to unite our strength to maintain international peace and security,
3, - and to ensure the acceptance of principles and making plans for her not to use armed force in the common interest,
4 - to employ international machinery for the promotion of the economic and social advancement of all peoples,


Of the preamble above, we proceed in what we write and ask you, ladies and gentlemen in the International Court of Justice, because we are history, civilization and belong to the land, a nation of anthropology of law and the law and the country that belongs to him Hammurabi, the first from the age of Sharia law in the history of mankind, and we have in our personality Iraqi freedom, peace and love of peaceful coexistence between the peoples of the earth so we started building our human homeland on the basis of love and peace.
As we were living in a lasting peace in our homeland Iraq people and not one divided by one word under the authority of the system he had given all the legitimate rights of the Iraqi citizen who has lived in Iraq under the authority of legislative, executive and the system is obliged to provide all the legitimate rights and in all social areas related to humans, the Iraqi and we enjoy all the legitimate rights enacted by the Iraqi constitution and no difference between segments of Iraqi society in multiple rights and duties.


Based on Article II of paragraph 3 and 4 of the Charter of the United Nations

Article 2

3 - All Members shall their international disputes by peaceful means on the face does not make peace and security, and justice are not endangered.
4 - All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any State or in any other manner inconsistent with the purposes "of the United Nations" ..

, Was attacked on our homeland and occupation of Iraq and the abolition of political and economic independence by an alliance of US-led colonial U.S. and Britain, countries which are allied with them since 20.03.2003 contrary to the principles of the Charter of the United Nations and the cause of this attack from the colonial occupation of our country


The results of the occupation are:

5 - cancellation of military and security institutions and the media, which are detailed the main protection of the unity of the Iraqi people and protect Iraq's sovereignty and integrity of its borders from external aggression and the establishment of place of an army of sectarian militias and racism, which have no loyalty to the national affiliation, but operating under the political blocs.

Based on Article VI of the UN Charter, which states:

Article 6
If you dwell member of the "United Nations" in violation of the principles of the Charter of the General Assembly may be expelled from the body on the recommendation



In Chapter VII, Article 39 of the Charter below:

Article 39
Security Council decides whether there has been a threat to peace or breach of, or was what happened an act of aggression and shall make recommendations or decide what measures shall be taken in accordance with the provisions of Articles 41 and 42, to maintain international peace and security or restore.

In Article 51 of Chapter VII below:

Nothing in this Charter shall impair the inherent right of individual or collective self-defense if an armed attack occurs against a Member of the "United Nations" and to the Security Council to take measures necessary to maintain international peace and security, and the measures taken by Members in the exercise of the right defense of self-reported to the Board immediately, and do not affect these measures in any way with the Council - under the authority and responsibility of the provisions of the Charter - the right to be made at any time as it deems necessary for taking actions to maintain peace and international security or restore.

We are Iraqis for liberation and supporters all the trends that are in the justice and peace in the world we support reflect an inclination towards the real in order to show the facts and provide all the criminals who have contributed to the destruction of world peace in the world who risk policy of their countries and peoples and its political future and its future relations with the peoples

We are in the name of the principles of international peace and justice we make this request of your court implementation of the above items of the UN Charter and United, which you Sanka International Tribunal for the main associated with the United Nations to take legal measures to separate the expulsion of all permanent members and non-permanent UN who participated in the attack on and occupation of Iraq, as well as issue a warrant for the arrest of all leaders States that have contributed to the occupation of Iraq, led by the criminal terrorist former U.S. President George W. Out To develop friendly relations among nations based on respect for the principle of equal rights of peoples and that each one of which self-determination, as well as taking other appropriate measures to strengthen universal peace;
And achieving peace and justice among peoples
